On China's Compulsory Certification System

In April 2001, by the decision of the State Council, the State Administration of Quality and Technology Supervision merged with the State Administration of Entry-Exit Inspection and Quarantine to form the General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China (referred to as the General Administration of Quality and Quarantine). The State Certification and Accreditation Regulatory Commission shall be responsible for the management and implementation of the compulsory national product certification system. For products that are compulsorily certified by the state, the State shall publish a unified catalogue, determine uniformly applicable national standards, technical rules and implementation procedures, formulate uniform marks and stipulate uniform charging standards. All products listed in the compulsory product certification catalogue must be certified and qualified by the certification authority designated by the state. Only after obtaining relevant certificates and applying certification marks can they be sold, imported and used in business activities.

      The new compulsory product certification system came into effect on May 1, 2002. In order to ensure the smooth transition between the old and new systems, the original product safety certification system and import safety and quality licensing system were abolished from May 1, 2003.

      According to China's WTO accession commitments and the principle of national treatment, the state uses a unified symbol for compulsory product certification. The name of the new national compulsory certification mark is"Compulsory Certification in China",The English name is"China Compulsory Certification",The English abbreviation is"CCC"。After the implementation of compulsory certification marks in China,Will gradually replace the original implementation"The Great Wall"  Signs and"CCIB"Signs.

      According to the national compulsory product certification(hereinafter referred to as"3C certification")The relevant documents stipulate that Since May 1, 2003, 132 products of 19 categories listed in the first batch of 3C certification catalogues can not be sold, imported and used in business activities without the 3C mark. However, in view of the special situation in production, import and business activities, the State Authentication and Accreditation Supervision and Administration Commission of China issued the No. 8 Announcement of 2002, which stipulates that some products can apply for exemption from 3C certification. These products include: 1. products imported and manufactured for scientific research and testing; 2. components imported by means of feeding or incoming processing for the purpose of exporting the whole machine; 3. products specially exported under foreign trade contracts (excluding domestic or domestic sales of the products); 4. components imported for testing technology import production lines; 5. direct imports; The products imported and manufactured for the end-user's maintenance purpose, the repair parts provided for the products that have stopped production, and the products under other special circumstances. For products exempt from 3C certification, the manufacturer or agent shall submit an application to the State Certification and Regulatory Commission of China, and submit certification materials, liability guarantee certificates and product conformity statements (including formal test reports) that meet the exemption requirements.Approved《Exemption from compulsory product certification》It has been in effect since May 1, 2003. In addition, the State Certification and Accreditation Supervision and Administration Commission has stipulated that for the products exempted from 3C certification mentioned above, the domestic assembly plants or domestic manufacturers may apply for exemption certificates from 3C certification to the inspection and Quarantine Bureau or the State Certification and Accreditation Supervision and Administration Commission directly under the host country according to their own convenience.
